BREAKING: PA Supreme Court stops the theft

In mid-September, election integrity won a significant victory in Pennsylvania when the Commonwealth Supreme Court ruled that misdated mail-in ballots should not be counted.

However, after the November 5 election, some election officials in Pennsylvania, apparently dissatisfied with the election results (and particularly the Senate election, in which Republican Dave McCormick narrowly defeated incumbent Democrat Bob Casey), decided that they would have to do it themselves would not comply with the Supreme Court’s order and would continue to count incorrectly dated ballots anyway.

Lest there be any confusion among said officials as to whether such continued counting is lawful or not, the Supreme Court of Pennsylvania weighed in again on Monday, clarifying that in no case will misdated absentee or absentee ballots be counted .

The order, which can be viewed in full below, states in relevant part:

The court hereby Assumes it his King’s Bench authority over the present application, see 42 Pa.CS § 502, only applies DIRECT that all respondents, including the Boards of Elections in Bucks County, Montgomery County and Philadelphia County, MUST do the following: TAKE PLACE with this court’s prior rulings in which we have clarified that absentee and absentee ballots that do not meet the requirements of the Pennsylvania Election Code, see 25 PS §§ 3146.6(a), 3150.16(a), WILL NOT COUNT for the election on November 5, 2024.

In other words, to the election boards who continue to violate the law: stop it.

RNC Chairman Michael Whatley issued the following statement on X following the court decision:

MCCORMICK/CASEY RECOUNT UPDATE:

Following our recent RNC lawsuit, the Pennsylvania Supreme Court today again ruled that undated ballots CANNOT be counted.

No more excuses. Election officials in Bucks, Montgomery, Philadelphia and other counties have absolutely no choice but to reject illegal ballots. We will hold them to it.

Protect your voice!

The race is already facing a recount because the difference is within 0.5 percent (and Casey has declined to waive the recount).

Now the electoral committees have been clearly informed not to count the ballot papers in question. Will they follow the court’s order? We will provide any updates as they become available.
