New York (AP) – A former democratic commissioner of the Equal Employment Opportunity Commission filed a lawsuit on Wednesday in which she questioned her dismissal by President Donald Trump and argued that her removal was a violation of the Civil Rights Act, which created the agency as an independent and cross -party protective protector of the rights of workers.

Jocelyn Samuels and another democratic commissioner came from the five-member EEOC Commission in January, an unprecedented step that swept away with an vital obstacle for Trump’s campaign for rejection of diversity and inclusion programs, the final protection for transgender and non-cheap workers and other priorities. Democracy Forward, a civil rights organization that leads several other cases against the Trump government, submitted the lawsuit in the name of Samuel before the US district court in the Columbia district.

“This abrupt and illegal termination before the end of my term not only violates the federal law, but also evokes the independent structure of the EEOC,” said Samuel an explanation.

The White House did not immediately answer inquiries to seek a comment on the lawsuit, which Trump, the EEOC and EEOC Chairman Andrea Lucas calls as a accused. The EEOC said through a spokesman that it would not comment on legal disputes.

Had Samuels and the other Commissioner, Charlotte Burrows, were able to end their five years of office, the EEOC Commission would have had a democratic majority in Trump’s presidency. It was the first time in the 61-year history of the EEOC that a president has released representative before their terms, even though the White House and the Conservative Rights Expert argued that nothing in the law banned to do this.

Samuels’ lawsuit, however, argued that the congress, which in 1964 created the EEOC by the Civil Rights Act, “did not grant the presidential authority to remove EEOC commissioners at will.” Instead, the congress found that the congress found that commissioners, appointed by the President and confirmed by the Senate, would be staggered to ensure “continuity, stability and insulation from political pressure”.

The EEOC forces several laws, including titles VII of the Civil Rights Act, prohibiting discrimination based on breed, gender, religion and national origin. In most cases, US workers who want to submit a complaint about violations of civil rights must go through the EEOC.

Lucas, a Republican who was first appointed by Trump in 2020 and was appointed acting chair in January, quickly moved to investigate the company control, which she argues, including the sending of letters to 20 prominent law firms, which demands detailed information about her diversity.

It has also taken steps to fulfill Trump’s executive order and to explain that the federal government will only recognize two genders, female and male. In the name of workers who claimed or harassed at least seven of his own lawsuits due to their gender identity, the EEOC has claimed that they were released or harassed.

Before they were released, Samuels and Burrows, together with a remaining democratic commissioner, Kalpana Kotagal, gave explanations that protested against Trump’s executive commands in order to coordinate and remove the protection for trans- and non -bin dyes, and said the orders undermined the mission of the EEOC, workers from discrimination. In her complaint, Samuels said in a letter to her that the White House quoted her support for Dei as “behavior” in which she justified her distance.

In the lawsuit it is also claimed that the dismissal of Samuels and Burrows is unlawful the EEOC commission without the quorum to make crucial political decisions. The EEOC now only has two commissioners, Lucas and Kotagal because another Republican Commissioner, Keith Sondery, who left the EEOC when his term of office lasted last year and is now the deputy minister of labor.

Trump has not yet announced his tips for the three vacancies. According to the Civil Rights Act, the EEOC commission can not have more than three members from the party that controls the White House, which means that Trump has to nominate a democrat to one of the three vacancies.
