A sign on the front of Gordon Algoes West Side house asks the gas workers of the mountaineers to restore the Gasservice of his family. In November 2023, a gas failure affected by around 1,000 inhabitants on Charleston’s West Side for weeks. (Lori Kersey | West Virginia clock)

Governor Patrick Morrisey has approved a legislative proposal sponsored by the Democrat in which supply companies have to draw plans to create customers about failures and a further law on establishing procedures for filling vacancies in government offices.

House bill 3263 was introduced in response to a November 2023 gas failure As a result, more than 1,000 inhabitants of Charleston’s West Side became without heat and the ability to cook. The failure was caused by a “significant persistent water leak”, which, according to the Mountaine gas, infiltrated 46 miles of the company’s natural gas distribution system.

The invoice requires that such communication plans contain at least one way to notify customers before planned service disorders, communication methods and to include an estimate of the duration and end of the failure. The plans are to be submitted to the West Virginia Public Service Commission. The invoice is effective on July 10th.

“We would think that supply companies would already be necessary to effectively communicate with their customers during this type of situations and in failures, regardless of whether they are planned or unexpected,” said DEL. Mike Puschkin, D-Kanawha, a resident of West Side and sponsor of the legislation. “You would think that would be the law. What we found out at the end of 2023 is that this was not the case.

“The tariff payers, the customers on the west side, were not well informed,” he said. “We received our information from the media. We have not received updates from the utility.”

Puschkin originally presented the legislative template during the legislative period in 2024. It had unanimous support in the house, but was in the Senate, he said.

The legislation codes a requirement that the Commission for Public Services already has for supply companies. In an order in October 2024, the PSC prescribed that the supply companies and cable companies have text and e -mail messages to inform customers about failures.

Legislation is one of two with democratic sponsors who Morrisey signed this year, said Puschkin.

The governor also signed Senate Bill 586Which requires that when filling vacancies of state officials, judges, judges and judges, the appointment is carried out by the same party, which had the seat at the time of the election, not the party to which the civil servant may have changed before he has resigned.

“This is a law on the basic fairness and the guarantee of the voters will, and not the party in power, is reflected in the filling of vacancies in the legislature,” said Bill sponsor Joey Garcia, D-Marion, in a press release.

The invoice was referred to as “de Soto Bill”, an indication of Joseph de Soto, whose headquarters were cleared in the House of Delegated After he was arrested because of threats to harm and kill the legislators. De Soto was elected as a Republican in November, moving to the Democratic Party hours before his arrest. Morrisey appointed a Republican to the seat. The Democrats made a legal challengeand argue that the Republicans of the Republicans have not followed the right constitutional procedure clear And that there was a precedent that the seat should go to Democrats due to de Sotos party age.

2014 earlier Senator Daniel Hall changed the parties From the Democrat to the Republican, just a few days after the election, the body was controlled to the GOP. He resigned from the Senate in December 2015 and left some Ask which party should fill the seat. Next year the state’s Supreme Court decided that Republicans should replace Hall.

“The Supreme Court misunderstood it in 2016 when he ignored the will of the voters that Daniel Hall’s seat could go to a Republican and ignored the fact that Hall was elected as a democrat,” said Puschkin in a press release on Wednesday. “The Republicans in the legislator misunderstood it in 2018 when they coded this bad decision in the law because they politically benefited them. We knew that it was a bad law when the Republicans got involved in knot at the beginning of this year to ignore the law that they did not have to fill in 2018 so that they did not have to fill the vacancy.
