Washington (AP) – The Trump administration asked the Supreme Court on Thursday to remove Lisa Cook from the Federal Reserve Governor Council.
The Republican government turned to the High Court after an appellate court refused to with Oubing Cook, part of President Donald Trump’s efforts to redesign the Fed’s Seven board and to delete it in his independence.
The White House campaign to relieve Cook marks an unprecedented offer to redesign the Fed Board, which is largely independent of daily politics. No president has released a seated governor in the 112-year history of the agency.
Cook, who was appointed to the Fed’s board of directors by President Joe Biden, a democrat, said she would not leave her post and is not “bullied” by Trump. One of her lawyers, Abbe Lowell, said that she would “take over her jury as governor of the Senate”.
Regardless of this, the Republicans of the Senate confirmed Stephen Miran on Monday, Trump’s candidate in an open place on the Fed board. Both Cook and Miran took part on Wednesday, where the Fed lowered its key interest rates by a quarter.
The next opportunity for Cook to make a vote is at the meeting of the Fed interest rate committee, which is planned for October 28th to 29th.
Trump tried to relieve the cook on August 25th, but a federal judge decided last week that the distance was probably illegal and that she was using the Fed’s board again. Trump accused Cook of the mortgage fraud because in June and July 2021 it was apparently claimed as a “primary residences” in Michigan and Georgia before they included the board. Such claims can lead to a lower mortgage and a lower deposit than if one of them has been declared as a rental property or second home.
“Simply put, the president can reasonably find that the interest rates paid by the American people should not be determined by a governor who apparently lied about facts for interest rates that she has secured – and refuses to explain the obvious false representations,” wrote General Prosecutor D. John Sauer in his files of the Supreme Court.
But Cook contested any misconduct and was not charged with a crime. According to the documents received by The Associated Press, Cook stated that her apartment in Atlanta would be a “holiday home”, according to a loan estimate that she received in May 2021. In a form in which they sought a security approval, she described it as a “2nd house”. Both documents seem to undermine the Trump government’s claims for fraud.
The US district judge Jia Cobb decided that the administration had not met the legal requirement that Fed’s governors can only be released “for the reason”, which had restricted them to misconduct in office. Cook only joined the Fed board in 2022.
Cobb also believed that Trump’s shooting would have withdrawn the cook of her proper or legal law in order to contest the discharge.
With 2: 1, a committee of the Federal Court of Appeal in Washington refused to carry out the administration’s application to carry out Cook’s discharge.
Trump’s lawyers have argued that her alleged action, even if the behavior took place before her time as a governor, “undeniably questioned that Cook’s trustworthiness is questioned and whether she can be a responsible administrator of interest rates and the economy”.
Trump has previously received the conservative majority of the court to release the presidential leaders of other independent federal authorities, including the National Labor Relations Board and the Federal Trade Commission, even if the legal fights are continued.
These shots were given in stress, for no reason. The Supreme Court distinguished the Federal Reserve from these other agencies, which emphasizes that Trump cannot act against Fed’s governors for no reason.
In his fresh registration at the Supreme Court, the administration asks the highest judge John Roberts for a transient order that Cook would effectively remove from the board, and a more enduring order from the entire court, which would be present during their legal case.
