Voter ID and closed GOP primary – changes WV voters should be aware of in the upcoming primary

There are notable changes for West Virginia voters in the upcoming May primary, including modern voter identification rules and a closed Republican primary.

West Virginia residents will have the opportunity to vote for their primary candidates in congressional elections and several state Senate and House races. Elections to the West Virginia Supreme Court of Appeals are also on the ballot.

“Your vote is even more important than it was in the presidential election because you will be a tiebreaking vote, you could be a tiebreaking vote. I mean, what we’ve seen in 2022 and in many of our state general elections, some of them came down to less than 10 votes,” said Josh Holstein, chairman of the West Virginia Republican Party. He also serves in the House of Representatives.

Early voting runs from April 29th to May 9th. Primary election day is May 12th.

“You need to plan your vote,” said Judy Ball, co-president of the League of Women Voters of West Virginia. “We always encourage people to take advantage of early voting.”

The law has changed the state’s voter ID requirements in 2025 as part of a GOP push to preserve “election integrity.”

“This common-sense legislation secures West Virginia’s elections and inspires confidence in the electoral process,” said Governor Patrick Morrisey when signing the law.

This is the first nationwide election in which eleven previously accepted forms of identification have been eliminated. Medicaid cards and utility bills are among the options no longer valid at polling places.

Voters must have a photo ID such as a driver’s license, passport or resident card to vote in person.

Ball said the League of Women Voters of West Virginia has focused on educating people about the change in the ID requirement before the area code.

“It’s like our Legislature is doing its best to make voting complicated in West Virginia,” she said. “We remind people that if they don’t have these IDs, they need to get them as quickly as possible.”

“The population demographics in West Virginia are such that the elderly and those with disabilities may be most impacted by this change in law. That is why we are trying to make it clear that there is an option to obtain a photo ID from the county clerk’s office, but you must act in advance,” Ball continued.

All ID cards requested from the district office will be issued free of charge.

Anyone who cannot present a valid photo ID at the ballot box can still cast a provisional vote after signing an affidavit confirming their identity. Once election officials verify their identity, the provisional ballot should be counted as long as the person is an eligible voter.

Democratic lawmakers voted against it the bill with the voter ID changes during the 2025 legislative session, arguing that it presented an unnecessary obstacle in a state with low voter turnout.

“Look, whenever Republicans make changes to election laws, the focus is almost always on the same thing: how to make voting more difficult and less convenient for people. They’re not trying to get more West Virginians to participate in our democracy; they’re trying to get fewer people to vote because that helps them stay in power,” said Mike Pushkin, chairman of the state Democratic Party, who also sits in the House.

Closed GOP primary

For the first time since the mid-1980s, the West Virginia Republican Party has done so has closed its area codemeaning only voters registered as Republicans can vote in the primary.

“Independents in the state, if they want to vote Republican, must be registered as Republicans before April 21, the deadline,” Holstein said. “We have made extensive efforts, particularly in the last two months, to reach voters directly from the state party through mail, through digital measures and through direct contact with voters.”

The The West Virginia Republican Executive Committee voted to close Republican primaries to independent voters starting in 2026. The decision was made before Holstein Appointment as party leader.

Holstein noted that, according to the West Virginia Secretary of State, about two-thirds of West Virginia voters who participate in the primary are registered as unaffiliated and are requesting a Republican ballot.

“We believe that if we reach enough people, a lot of them will come over because they’ve already been voted in our primaries anyway,” Holstein said.

Republican voter registration in West Virginia is up 13% 3,842 voters from the end of February to the end of March reporting from Parkersburg News and Sentinel.

Independent voter registrations in the state fell by 1,022 during the same period.

“That gives me courage,” said Holstein.

Pushkin called the closed GOP primary another obstacle for West Virginia voters.

“All of this isn’t about encouraging participation in the democratic process — it’s about maintaining power, just like the legislative redistricting we’ve already seen,” he said. “They wrap everything up in rhetoric about ‘election integrity’ and ‘voter fraud,’ but never provide evidence of widespread fraud that would justify these types of restrictions.

“West Virginians deserve a system that encourages participation, not one that creates more barriers. We should make voting easier, not harder.”

April 21st is the last day register to vote or change party affiliation.

A postal vote must be requested by May 6th.
