CHARLESTON, WV (WOWK) – She may be one of the most popular pets in America right now, but a painting of Babydog could now be the subject of a legal dispute.
Attorney Harvey Peyton has been contacted by people concerned about Babydog’s image being painted into a historic mural in the Capitol Rotunda. He wants to know how much it cost and whether the proper legal procedures were followed in deciding to include the dog’s image in the mural.
“It’s not about Babydog. It’s the precipitating event that brought attention to it. To me, it just seems like another extension of the arrogance and disregard for the law that seems to accompany this project,” said Harvey Peyton, host of “Ask the Lawyer” on WCHS Radio.
“Give me a break, I mean for God’s sake. You know, I think we should just… You know, if we’re just throwing rocks at each other here and everything, then that’s just the way it is,” said Gov. Jim Justice (R-WV).
Attorney Peyton gave the Capitol Building Commission a “notice of potential litigation,” which is required before initiating formal action. He said he would gather more information before deciding to file suit.
Governor Justice says no one asked him if Babydog was in the mural. He only found out about it on the day of the unveiling and said he really liked it.
Babydog brought a lot of national attention to West Virginia this week when she and Governor Justice went to the Republican National Convention in Milwaukee.
