That’s Tester in a nutshell. He is a typical Beltway-loving Democrat who has been a reliable partisan at every opportunity. He’s not a Montana-first moderate who fought back against the radicals in his midst.
Dominion and Georgia are on trial
In normal litigation, the parties always present their procedural defenses first. But this is about election integrity in Georgia, one of the most watched and controversial issues in our country. Isn’t that worth a direct response from a Republican administration?

When a taxpayer-funded official with access to children shows a clear tendency to repeatedly incite violence in public forums, the silence of his superiors in local government and the local press is not a virtue.

Today on Capitol Hill…
With the animals essentially out until after the election, there will be some serene days on the Hill. One wonders if some of them are (involuntarily) spending their last days as living beings. See e.g. B. Jon Tester.
Senator Rick Scott (FL) is vocation that the Senate will meet again following Helene to discuss a disaster aid package.
Oh, and House Oversight Chairman James Comer (R-KY) has some questions about China Tim that he’d like to see answered.
What’s going on in the White House?
President Joe Biden is set to receive some additional information about the impact of Helene and then a phone call with certain rabbis before the High Holidays.
The home stretch
Vice President Kamala Harris is in DC on Tuesday for internal meetings and such. Her husband, Second Gentleman Doug Emhoff, will attend a campaign rally in Milwaukee, Wisconsin. And it’s the large night for her running mate, Minnesota Gov. Tim Walz, as he takes on Sen. JD Vance (R-OH) in the vice presidential debate in New York.
As Vance prepares for the debate, former President Donald Trump will also be in Wisconsin on Tuesday afternoon to speak at an event in Waunakee.
Full court press…
It is unclear whether Judge Chutkan will decide today which parts of Special Counsel Jack Smith’s motion outlining all of Trump’s alleged wrongdoing (to resolve the immunity question) will be unsealed and made available to the public, but Trump objects against Smith’s proposal Editorials are due at noon today. And once the court receives the objections, I expect it to decide fairly quickly. So get ready for breathless coverage once Smith’s proposal is made public.
Sean “Diddy” Combs is appealing the denial of bail in his criminal case in the Southern District of New York. It will be compelling to keep an eye on this.
Additionally, the recently released Julian Assange gave testimony to the Parliamentary Assembly of the Council of Europe in Strasbourg, France, on Tuesday morning.

Morning rumination
Well, it’s here. October (my least favorite month for numerous reasons). And Vice Presidential Debate Day (Night). The assumption that Vance will be fine is not unfounded. He is quick, quick-witted and knows his stuff. But Walz will of course have the moderators on his side. And I suspect that the revelations and hints of his nervousness about the affair were a deliberate attempt to keep expectations fairly low so that when he overcomes them, everyone can emulate his infamous seal clap and bark about what a wonderful job he is doing has accomplished.
