Lincoln, Neb. (AP) – Art Life Dispensary offers cannabinoid gums, tinctures, ointments that have been offering such products as one of the first companies in Nebraska for seven years. The founder and co -owner Andrea Watkins said her company was very successful, and she now had three locations in the capital of Nebraska, who employ eight employees and sell hundreds of regular guests who exploit the products to treat everything from pain and pain to anxiety and post -traumatic stress disorder.

But now she fears that her livelihood will be crumbled if a legislation of Nebraska, which she sells, would extend the path.

Nebraska’s law would criminalize the sale and possession of a series of products that contain tetrahydrocannabinol or THC, which gives the same area that marijuana gives its psychoactive properties. Every product that contains more than a total weight of 0.3% THC or more than 10 milligrams per package is prohibited.

“If this draft law becomes law? We would have to close,” said Watkins recently in her flagship business, which looks like a cross between a pharmacy and a spa.

It suspects that many of the more than 300 companies offer similar products in the whole of the state, since Hanf was legalized as part of the 2018 Federal Law. This farm bill created a legal gap with which manufacturer can synthesize and sell THC from hemp systems and sell in products in which marijuana is not legally to be sold.

As the invoice is currently written, even topical products such as THC-containing lotions and creams that are supposed to have joint joint and muscle pain will be forbidden, and the opponents will cause the Bill sponsors to make criminals from grandparents looking for treatment for arthritis.

“What happens to all the grandma who have a kind of CBD with Delta-8 in the back of your medicine cabinet?” The Senator of Omaha, Wendy Deboer, asked during the recent debate about the draft law in Nebraska and added that the invoice with products with hemp-based THC would “make criminals of all grandmas” for painful joints.

The law of Nebraska will comprise a grace by the end of 2025 that enable people who have such products to dispose of them.

The debate about cannabinoid products

The Republican legislator behind Nebraska’s draft law says it is necessary to protect people – especially children – from unsafe products that exploit synthetic cannabinoids that “camouflage as hemp” and are infused with sweets and observations in food and drink. Several legislators have reports of children and others who suffered effects and even hospital stays after consuming products with synthesized THC.

Those who incorrectly characterize the tactics that characterize the advantages of the products, but are tactical for fear, said Dr. Andrea Holmes, expert in organic chemistry with a focus on cannabis. Holmes is a co-owner of cordial life transactions and traveled through the country to promote regulated cannabis and cannabinoid products.

“In these cases that you talk about, the person is also a different substance or has an underlying problem that leads to their condition,” said Holmes. “Our products are not dangerous.”

The opponents of the law say that it is part of the state’s republicans – including the Attorney General of Nebraska, Mike Hilgers – to criminalize hemp products and to thwart the growing efforts to legalize marijuana in both Nebraska and all over the country. Dozens of states have legalized marijuana for medical or leisure exploit. In November, the voters in Nebraska approved mostly medical marijuana.

“We have to look at this fact. Most people want this kind of products,” said Holmes.

A proposal for the regulation instead of a ban

So far, the legislators of Nebraska have rejected the efforts of the Democrat of Omaha Senator John Cavanaugh, Senator John Cavanaugh, to replace the ban with a measure that would require a strict regulation of hemp-based consumption materials, as several other states have done. The Nebraska Hemp Industries Association supports Cavanaugh’s efforts to regulate the industry.

Cavanaugh and supporters of his measure say that the ban on hemp products at a time when the state suffers from dramatic revenues would only hit the state health insurance companies harder.

In hemp-derived cannabinoid companies, more than 1,600 employees in Nebraska and give the state a tax income potential of almost $ 8 million, said Cavanaaugh, referring to figures from the US Cannabinoid report 2023.

Despite the decriminalization of hemp and the approval by the voters for some marijuana consumption, Hilgers has to sell the cannabinoid products on a hemp basis. Many shops have received wease-and-desist letters. Some were attacked by law enforcement authorities. Hilgers insists that he protects the public from unsafe products and unscrupulous dealers.

“With our new complaints, we increase our efforts to clean up Nebraska,” said Hilgers in September, when he sued four companies in Norfolk, who sold hemp-based consumption materials. “These businesses are misleading Nebraskans. No of the products we tested were precisely identified, and many contained controlled substances.”

Nebraska is far from restricting access to consumable hemp and other THC products. It is followed by a number of other countries in which similar efforts to regulate, criminalization or prohibition of such products, including Alabama, Florida, Tennessee and Texas, to regulate, criminalize or forbid.

However, democratic states have also led efforts to restrict hemp products. In California, where the marijuana consumption for leisure time is legally and heavily regulated and taxed, the supervisory authorities spent a ban on food and beverage products with hemp-derived THC last year, citing health concerns.
