California sets new standards to protect transgender students

California has thrown down a new gauntlet in the fight for transgender students.

Governor Gavin Newsom (D) this week a law signed Teachers could not be required in most cases to inform parents of a student’s name or pronoun changes, leading to at least one district filing a lawsuit and tech billionaire Elon Musk announcing that he would his business from the state.

While LGBTQ activists say the law will prevent forced outings and protect adolescent people, opponents argue that California is withholding crucial information about their children from parents.

The move is the first of its kind and comes after several schools in the state attempted to implement policies requiring the opposite.

“This bill would do three things. It would protect LGBTQ youth from coercive outing policies, provide resources for parents and families of LGBTQ students, support them in having conversations on their own terms, and create important safeguards to prevent retaliation against teachers and schools who seek to promote and create a safe and supportive school environment for all students,” said Tony Hoang, executive director of Equality California.

The Trevor Project found in 2022 that about 16 percent of LGBTQ youth reported running away from home, and 55 percent said they left home because of abuse or fear of abuse because of their LGBTQ identity.

The law only allows educators to notify parents of gender identity changes if a student requests a change to their official record with the school.

California lawmakers pushed for the measure after several schools in the state wanted to implement a policy that would require a teacher to inform parents each time a student asks to be addressed by a different name or pronoun.

“Governor Newsom’s signing of AB 1955 is a direct attack on the safety of children and the rights of their parents,” said Jonathan Keller, president of the California Family Council. “By allowing schools to withhold important information from mothers and fathers, this bill undermines their fundamental role and puts boys and girls in potential danger.”

The new law has already been faced with a lawsuit from the Chino Valley Unified School District, one of the districts the state previously sued over its policies toward transgender students. The suit alleges that California is violating parents’ constitutional right to dictate the education of their children.

“School officials do not have the right to keep secrets from parents, but parents have a constitutional right to know what their minor children are doing at school,” said Emily Rae, an attorney representing the district.

The Republicans have agreed on Parental Rights Notices in its education programme, with the aim of adopting national legislation on this issue in the event of its renewed presidency.

“The Constitution guarantees parents the fundamental right to determine the upbringing, education and health care of their children. This law interferes with that right by preventing schools from adopting policies that inform parents,” said Vincent Wagner, senior attorney at Alliance Defending Freedom (ADF). “So this is an issue that runs afoul of the Constitution and the fundamental rights of parents under the Constitution, and it also runs counter to the scientific evidence that shows that parental involvement is essential to quality health care for children.”

Musk, the founder of SpaceX, said he would move his company headquarters from California to Texas, adding that the goal of the “diabolical law is to destroy the parent-child relationship and give the state control over your children.”

At least six states have laws requiring teachers to inform parents if a student reveals they are transgender.

But supporters of the new California law say it helps keep children secure and doesn’t prevent parents from discussing their child’s identity. It just takes teachers out of the picture.

“This is a deeply frivolous lawsuit that appears to be aimed at stoking the garbage fire formerly known as Twitter rather than bringing legitimate legal claims to the surface. AB 1955 preserves the relationship between child and parent, California law ensures that minors cannot change their name or gender without parental consent, and parents continue to have guaranteed and full access to their children’s school records, under federal law. We are confident the state will prevail quickly in this case,” said Izzy Gardon, spokeswoman for the governor.

Hoang said a New York state senator will introduce a bill similar to California’s, “because ultimately we want to keep teachers out of this equation and give parents and children their own schedule and the opportunity to have these conversations on their own terms.”

“Because we want to build trust, not remove that trust from that relationship by sending teachers into schools as police officers monitoring a child’s sexual orientation and gender identity,” he added.

Lawsuits are underway in several other states over policies that critics say violate parents’ right to know what is happening to their children at school.

“This is not a new problem. At ADF, we have multiple cases across the country, from coast to coast and everywhere in between, involving schools excluding parents from important decisions about their children,” Wagner said. “We represent parents in western Michigan who have sued their school district for deceiving them about treating their daughter as a boy without their knowledge or consent.”

“This may be the first law of its kind, but it’s not the first time we’ve seen these issues. We’re tracking them nationwide and trying to support parents who are trying to get the help they want without interference from school districts across the country. And we’ll continue to do that,” he added.
