FINALLY: Nevada judge dismisses lawsuit against six GOP defendants over ‘fake electors’

Citing the fact that the state’s attorney general brought the charges in the wrong court, a Nevada district judge has permanently dismissed the “fraud electoral college” case in the 2020 presidential election against six defendants – all Republicans – with the trial scheduled to begin in January 2025.

Clark County, Nevada District Judge Mary Kay Holthus on Friday dismissed the swing state’s charges against six Republicans who prosecutors said illegally submitted certificates to Congress certifying former President Donald Trump as the winner of the 2020 presidential election. In doing so, Holthus said, the office of Nevada Attorney General Aaron Ford, a Democrat, chose the wrong venue for the case.

Clark County, which Holthus presides over, is Nevada’s largest county and includes Las Vegas, the state’s most Democratic-leaning city.

Richard Wright, a lawyer for one of the defendants, state Republican Chairman Michael McDonald, accused Ford of bringing the case before a grand jury in Las Vegas rather than in Carson City or Reno, two northern Nevada cities in a predominantly Republican region where the defendants are alleged to have signed and submitted forged documents to overturn President Biden’s election victory.

It seems that the defendants’ submissions convinced Judge Holthus that there was something wrong with the prosecution’s argument:

The defendants’ court documents say the six Republicans met in Carson City, Nevada’s capital, which is in another county.

In addition to McDonald, the defendants included “Jesse Law, chairman of the Clark County Republican Party; Jim DeGraffenreid, a member of the party’s national committee; Shawn Meehan, a member of the national and Douglas County committees; Jim Hindle, a Storey County clerk; and Eileen Rice, a party member from the Lake Tahoe area.” If convicted, all of them could have received prison time.

Each of them was charged with submitting a false document for the purpose of filing and issuing a forged document – both criminal offenses carrying a prison sentence of up to four or five years respectively.

After the decision was released, a spokesman for Attorney General Ford’s office said prosecutors would “immediately appeal.”
