Jamie Raskin is the latest Democrat to violate the Constitution: He says the Electoral College can “kill you”

The Democrats are always blathering on about the supposed “threat to democracy” posed by Donald Trump and the Republicans, but they themselves are the ones who are constantly undermining the Constitution: with their attacks on the Supreme Court and their attempts to “reform” it, their endless attacks on free speech, and of course their stated goal of destroying the Electoral College.

Rep. Jamie Raskin (D-MD), who embarrassed himself by disregarding the Constitution by serving as lead lawmaker in Trump’s second silly impeachment trial, is the latest Democrat to make confused remarks on the subject when he spoke to the Free Speech Project at the Riggs Library in Washington DC on Friday.

He said of the electoral college: “Nowadays [it] can kill you.”

Wow. I knew it was vital, but I must confess I didn’t know it could kill you. The trial caused on January 6, he claimed:

“Instead of a convoluted, antique, antiquated system from the 18th century that can kill you today, as it almost did 6 January 2021,” he claimed.

“I mean, we met [at the Capitol] just because of the technicalities of the 12th Amendment, which says a joint session must be called to count the Electoral College votes submitted by the governors as part of the certification certificates,” he said. “But we knew who had won the election. Everybody knew who had won the election, but we’re still going through these 18th century rituals, and that gave Donald Trump the opportunity to call out to the mob, ‘Come here, we’re going to be wild,’ and then tell them to go out and ‘fight like hell,’ or they’d have no country left.”

He also claimed that a majority of Americans wanted to abolish the Electoral College:

In American history, five popular vote losers have become president, twice this century alone, in 2000 and 2016.

I think the enormous majority of Americans believe that we should elect the president simply by having an election based on who gets the most votes, rather than this convoluted, shaky system where it all comes down to a handful of states, six or seven states, rather than every vote counting equally across the country.

The problem is that constitutional provisions are not changed or abolished based on polls – you need a Constitutional amendmentwhich would require the approval of two-thirds of Congress and three-quarters of the states. Good luck with that, Jamie.

Moreover, the Electoral College was not created on a whim; the framers spent many hours and days debating how we should elect our president. Among other things, they tried to balance the referendum to ensure that the most populous regions do not simply overwhelm the rest of the country:

The Founding Fathers enshrined the Electoral College in the Constitution, in part as a compromise between electing the president by a vote of Congress and electing the president by a popular vote of eligible citizens. However, the term “Electoral College” does not appear in the Constitution. Article II of the Constitution and the 12th Amendment refer to “electors” but not to the “Electoral College.”

Because the Electoral College process is part of the original draft of the U.S. Constitution, changing this system would require the passage of a constitutional amendment.

There are many reasons why abolishing college sounds good but actually has unintended consequences. Here are some common arguments to leave it as intended:

The Electoral College ensures that all parts of the country participate in the election of the President of the United States…

The Electoral College was created to prevent the voices of the minority from being drowned out by the will of the majority.

The Electoral College can rule out calls for recounts or runoff elections, thus ensuring security in the presidential election.

Raskin and the Democrats hate the Electoral College because it tries to bring regional balance to our presidential elections and give a voice to smaller states, not just blue giants like California and New York.
