If you need more evidence that the Democratic Party is in freefall after Donald Trump’s stunning victory on Tuesday, look no further than their hair-brained plan to force a Supreme Court justice to resign before the GOP in January takes control of the Senate.
Democrats will face some chilly, tough truths this week, one of which is that they have lost control of the Senate. As of Friday morning, Republicans were assured they would have at least 53 seats, with one race yet to be called. That means the GOP will be in the next January words an equally panicked politician who is “reigniting the old conveyor belt of conservative judicial candidates and continuing to tilt the courts in their favor for decades.”
Unbeknownst to the braintrust at Politico, that’s exactly what voters want. The idea that the political party that just received an overwhelming mandate for change from the American people would have the power to influence the judiciary is of great concern to the left. Someone should ask them what they think now about packing the Supreme Court and eliminating the Senate filibuster.
One of the things the now-impotent Democratic Party thinks it can do to shake things up before the 119th Congress takes office on January 3, 2025, is a desperate, lame-duck attempt to influence the Supreme Court. And they have Justice Sonia Sotomayor in their sights.

This is a heated moment for Democrats. And although media discourse is currently dominated by accusations about how this all happened, another, arguably more pressing debate is raging largely outside the public eye: whether to stand up for the 70-year-old Supreme Court justice SONIA SOTOMAYOR to resign while Democrats still have the power to approve her replacement.
Lest you think this is some sort of Tim Walz-esque knee-jerk reaction from the left after their election defeat, Politico says It”is not just any flight of the imagination is happening among progressive activists online. It is a conversation in which members of the Senate are actively participating.”
All right then.
The idea is so incredibly bad that hardly any Democratic senators, including retired ones, have stepped forward to publicly present the idea to the American public. But supporters of the plan see Sotomayorwho is 70 years old and suffers from type 1 diabetes, as a political liability at a time when the Democrats are losing power. It would be a last gasp of rapidly waning influence to force Sotomayor to resign, as they failed to do with Ruth Bader Ginsburg, to secure a far-left voice and vote on the court for decades to come.
Voters have voted against this kind of left-wing harassment before. As you recall, one of the main reasons for Donald Trump’s first election in 2016 was the nerve-wracking prospect that, if elected, Hillary Clinton could appoint multiple Supreme Court justices, potentially negatively impacting America for generations.
Democrats have taken this complicated path before. In 2022, leftists urged Justice Stephen Breyer to retire after leading a lawsuit Intimidation campaign against him:
It was never a particularly subtle effort. Demand Justice, the far-left group dedicated to nominating judges in the massive dark money network Arabella Advisors, even launched a “Breyer Retire” campaign, complete with a Online petition tell the judiciary to resign immediately and a Billboard truck I drove around the Supreme Court building to convey this message. And the day after the announcement, the same truck took a victory lap and thanked Breyer.
This led to the independent-minded Breyer being replaced by Ketanji Brown Jackson, a leftist so enmeshed in liberal nonsense culture that she can’t even define what it means to be a woman.
It remains to be seen whether Democrats will move forward with forcing Sotomayor, rather than a left-wing justice activist, into retirement noticed, “Democrats won’t win elections forever. They will not be able to appoint Supreme Court justices indefinitely. They have to act when they have power.”
