One of the indignities facing Biden’s Justice Department and New York Attorney General Letitia James in his final days is how to handle the trumped-up criminal cases they are pushing against President Trump. The federal issue appears to have been resolved on Tuesday. Not only were the allegations obviously false and made by a questionable person appointed unconstitutionally prosecutor, but Justice Department policy is not to prosecute a sitting president.

A tougher case is the New York State civil case brought by Letitia James and Manhattan District Attorney Alvin Bragg’s fraud lawsuit, in which Trump was convicted and awaits sentencing; see BREAKING: Judge delays sentencing in Donald Trump’s Manhattan case until after election. This case is more hard because the DOJ cannot order a state to stop prosecuting a president, even though that would be uncharted territory; see What happens next in Trump’s New York criminal case after he wins the election? – The New York Times. Although the latter prosecution occurs at the local level, under New York law the attorney general has jurisdiction has the authority to take over the case.

I dare you, I dare you to attempt to continue your legal challenge against President Trump In his second term because, listen, honey, we’re not doing any nonsense this time, and we’re going to represent your opinion fat ass In Jail for conspiracy against rights. I promise you, so think long and difficult before you try to violate the constitutional rights of President Trump or any other American. That won’t happen again.
Mike Davis has a well-deserved reputation as a take-no-prisoners lawyer who has successfully taken on Trump. A recent Politico article followed his transitionin the words of Steve Bannon:
“Mike Davis was a typical Federalist Society Republican lawyer, right? Standard material. Played by the rules. Helped validate the guys, was able to play hard but stayed within bounds,” Bannon told me.

Chances are that James will give in, as she is playing a very frail hand against an overwhelming force. Still, it is refreshing to see that this recent Trump team is not intimidated by the political opposition. Davis is rumored to be the leading candidate for attorney general. Whether this interview helps or hurts his case is unclear, but I hope it helps.
